The LABOUR DEVICE (employment) of disabled people and other persons with the lowered working capacity — set of the stipulated by the legislation social and economic, organizational and legal and medical actions aimed at providing to disabled people and persons with the lowered working capacity of an opportunity to participate in socially useful work.
Employment of these persons is an important element of their social and professional rehabilitation (see). It promotes also inflow of an additional manpower to the national economy.
The legislation provided special rules of employment of three categories of persons with the lowered working capacity (see): disabled people (see Disability), pensioners on an old age and the persons who are not disabled people, but needing for health reasons change of working conditions.
Employment of disabled people includes: survey in a vr
of chebno-labor commission of experts (cm); development of labor recommendations; vocational education; a job placement, close to that, to-ruyu they carried out to an exit to disability; creation of special working conditions; control of the correct use of their work, compliance with the law about privileges to disabled people; dynamic overseeing by a condition of their health and working capacity. In system of the governmental and public activities on employment the leading role belongs to the conclusion of the medical labor commission of experts (MLCE).
In labor recommendations of VTEK the state of health and level of working ability of disabled people, their profession, specialty, qualification, personal tendencies, and also interests of society (the need for shots) and the actual opportunities of use of this or that form of employment are considered (see Examination). The conclusion of VTEK has validity and is obligatory for heads of the enterprises, institutions and the organizations.
The main forms of employment of disabled people — providing them with work in usual production and in specially sozdavayekhmy conditions at the usual enterprises, in institutions and the organizations by establishment of the facilitated working conditions, and also at home. Along with usual there are specialized enterprises, workshops with preferential use of work of disabled people and pensioners on an old age, e.g. specialized industrial practice workshops
about-in blind people and deafs (see Society of deafs, Society of blind people). At these enterprises a number of side benefits as for disabled people (the lowered norms, the increased compensation), and for the enterprises is provided (tax exemption, etc.).
Employment of disabled people shall be carried out first of all at those enterprises, in collective farms, institutions, the organizations where they worked before disability. In system of actions for employment of disabled people the prof. their training at courses, in technical training colleges, nursing homes and technical schools nursing homes of a social security system figures prominently. Finished these educational institutions bodies of social security according to the profession employ.
For disabled people of the Great Patriotic War at the enterprises, in institutions, the organizations the reservation of their priyekhm for work in limits to 2% of total number of workers and employees is established.
The duty to report to bodies for use of a manpower and bodies of social security of the data on vacancies and jobs is assigned to heads of the enterprises, institutions and organizations, on to-rykh disabled people and able-bodied pensioners on an old age can be used.
The workers, employees and collective farmers who do not have group of disability, but needing for health reasons special working conditions shall be transferred from their consent and according to the medical conclusion for other temporary or permanent job. The medical conclusion
about need of such transfer is given by the medical and consulting commission (see).
